      • Welcome to Fantasy Sports Math League ("FSML," "we," "us," or "our"), an educational gaming platform operated by dfusion Inc./STEMPlay Labs. By accessing or using the FSML website at fantasysportsmathleague.com (the "Platform"), you agree to be bound by these Terms of Service ("Terms").

      • If you do not agree to these Terms, do not use the Platform.

      • Who May Use FSML

        • Students: FSML is designed for students in grades 6-8 (typically ages 11-14). Students under 13 require parental consent through their school or parent/guardian.

        • Teachers and Educators: Teachers may create accounts to manage student leagues and monitor student progress.

        • Parents and Guardians: Parents may create accounts to participate in family leagues or monitor their child's participation.

        • Schools and Districts: Schools may register for institutional access for their students and teachers.

      • Parental Consent for Children Under 13

      • In compliance with the Children's Online Privacy Protection Act (COPPA), we require verifiable parental consent before collecting personal information from children under 13. This consent is typically obtained through school registration. Parents have the right to review their child's information, request deletion, and refuse further collection.

    • 2. Account Registration and Security

      • Account Creation

      • To use FSML, you must create an account by providing:

        • Name (first and last)

        • Email Address

        • Password

        • Grade Level (for students)

        • League Code and Password (to join a specific league)

      • Account Responsibilities

      • You are responssible for:

        • Maintaining confidentiality of your password

        • All activities that occur under your account

        • Notifying us immediately of any unauthorized use of your account

        • Ensuring accuracy of the information you provide

      • Teacher Accounts

      • Teachers have additional responsibilities:

        • Verifying they are authorized to register students from their school

        • Maintaining student privacy and confidentiality

        • Ensuring appropriate supervision of student participation

        • Managing league settings and student access appropriately

      • Account Termination

      • We reserve the right to suspend or terminate accounts that:

        • Violate these Terms

        • Engage in inappropriate behavior

        • Provide false information

        • Are inactive for extended periods (we will provide notice before termination)

    • 3. Educational Use and Purpose

      • Intended Use

      • FSML is designed exclusively for educational purposes to help students learn mathematics through real-world application using fantasy football concepts.

      • Acceptable Use

      • You agree to use FSML only for:

        • Educational instruction and learning

        • Mathematics practice and skill development

        • Classroom activities and assignments

        • Family educational engagement

      • Prohibited Uses

      • You may NOT use FSML for:

        • Gambling or wagering - No real money, prizes, or stakes may be involved

        • Commercial purposes - No advertising, selling, or business activities

        • Harassment or bullying - Respect all users

        • Cheating or academic dishonesty - Complete your own work

        • Unauthorized access - Do not attempt to access other users' accounts

        • System interference - Do not disrupt or damage the platform

        • Data scraping or mining - Do not extract data through automated means

        • Impersonation - Do not pretend to be another person or entity

      • School-Appropriate Content

      • Team names, mascot selections, and all user-generated content must be:

        • Appropriate for a middle school environment

        • Free from profanity, hate speech, or offensive language

        • Non-discriminatory and respectful

        • Compliant with your school's code of conduct

        • Teachers may change inappropriate team names at their discretion.

    • 4. Intellectual Property Rights

      • FSML Content and Ownership

      • All content on the FSML Platform, includeing but not limited to:

        • Software code and platform functionality

        • Lesson plans and educational materials

        • Graphics, logos, and design elements

        • Text, videos, and instructional content

        • Game mechanics and scoring systems

        • ... is owned by dfusion Inc./STEMPlay Labs or its licensors and is protected by U.S. and international copyright, trademark, and other intellectual property laws.

      • NFL Data and Third-Party Content

        • FSML uses NFL player statistics, team data, and related information provided through SportsDataIO's API service. This data is licensed to us for educational use only and is subject to the terms of our agreement with SportsDataIO.

        • Important Restrictions:

      • Limited Licnese to Users

        • We grant you a limited, non-exclusive, non-transferable, revocable license to:

        • You may NOT:

      • User-Generated Content

      • When you create content on FSML (team names, graphs, etc.), you retain ownership but grant us a license to display and use that content to operate the Platform.

      • Educational Materials License for Teachers

        • Teachers may:

        • Teachers may NOT:

    • 5. Privacy and Data Protection

      • Privacy Policy

        • Our collecgtion, use, and protection of personal information is described in our Privacy Policy. By using FSML, you agree to the terms of our Privacy Policy.

      • Key Privacy Commitments

        • COPPA Compliance - We comply with the Children's Online Privacy Protection Act

        • FERPA Compliance - Student educational records are protected per FERPA requirements

        • Minimal Data Collection - We collect only information necessary for educational purposes

        • No Selling of Data - We do not sell student information to third parties

        • Secure Storage - Data is encrypted and stored securely

      • Student Data Access

        • Teachers can view data for students in their leagues only

        • Parents can request access to their child's data

        • Students can view their own game data and progress

      • Data Retention

      • We retain student data only as long as educationally necessary or as required by law. Schools and parents may request deletion of student data at any time.

    • 6. NFL Data and Third-Party Content

      • Use of NFL Statistics via SportsDataIO

        • FSML accesses NFL player statistics, team information, and game data through SportsDataIO's licensed API service. This data is used solely for educational purposes to provide authentic real-world context for mathematical learning.

        • Data Source and Licensing:

      • Prohibited Uses of NFL Data

      • Users may NOT:

        • Extract or scrape NFL data from FSML for any other purpose

        • Create competing products using data accessed through FSML

        • Redistribute player statistics or team information outside of FSML

        • Use for gambling or wagering of any kind

        • Commercial exploitation of NFL data obtained through FSML

        • Combine with other data sources to create derivative databases

      • Data Accuracy and Availability

      • While we strive for accuracty, we do not guarantee:

        • Real-time updates - Data typically imports Tuesday mornings after weekend games

        • 100% accuracy - Data accuracy depends on SportsDataIO's data feeds

        • Continuous availability - Data may be temporarily unavailable due to API maintenance or technical issues

        • Historical completeness - Off-season data uses historical games from previous seasons

      • Service Interruptions

        • NFL data availability may be affected by:

        • We will make reasonable efforts to restore data access but are not liable for interruptions caused by third-party data providers.

      • No Affiliation with NFL or SportsDataIO

      • FSML is an independent educational platform. We are not affiliated with, endorsed by, or sponsored by:

        • The National Football League (NFL)

        • NFL teams or players

        • SportsDataIO

        • Any other sprots data provider

      • Third-Party Links

      • FSML does not contain links to third-party websites.

    • 7. Technical Requirements and Platform Availability

      • System Requirements

      • To use FSML, you need:

        • Chromebook, laptop, or desktop computer (tablets and smartphones not currently supported)

        • Modern web browser (Chrome, Firefox, Edge, Safari)

        • Internat connection

        • JavaScript enabled

      • Platform Availability

      • We strive to maintain consistent Platform availability but to not guarantee:

        • Uninterrupted access - Scheduled maintenance may cause temporary outages

        • Error-free operation - Software may contain bugs or errors

        • Compatibility with all systems - Technical requirements may change

        • Permanent availability - We reserve the right to discontinue the service with notice

        • Continuous NFL data access - Subject to SportsDataIO's API availability

      • Scheduled Maintenance

      • We will attempt to schedule maintenance during off-peak hours and provide advance notice when possible. Typically:

        • Sunday evenings or early Monday mornings

        • During NFL off-season when usage is lower

        • Emergency maintenance may occur without notice

      • Data Import Schedule

      • NFL game statistics are typically imported:

        • Tuesday morning following weekend games during NFL season

        • Historical data used during off-season (February - August)

        • Import timing may vary based on SportsDataIO data availability

    • 8. User Conduct and Community Standards

      • Expected Behavior

      • All users must:

        • Treat others with respect and kindness

        • Follow school and classroom rules

        • Complete their own work honestly

        • Report inappropriate behavior to teachers or administrators

        • Use appropriate language in all team names and communications

      • Prohibited Conduct

      • Users may NOT:

        • Bully, harass, or threaten other users

        • Use offensive language or hate speech

        • Cheat by sharing answers or using unauthorized assistance

        • Share account credentials with others

        • Impersonate other users, teachers, or administrators

        • Disrupt the learning environment or Platform functionality

        • Access other users's accounts or private information

        • Engage in gampling or wagering real money

        • Extract or scrape NFL data for use outside FSML

        • Use NFL data for commercial purposes

      • Consequences of Violations

      • Violations may result in:

        • Warning from teacher or administrator

        • Temporary suspension of account

        • Permanent account termination

        • Notification to school administration or parents

        • Removal from league or classroom participation

    • 9. Disclaimers and Limitations of Liability

      • Educational Tool Disclaimer

      • FSML is provided as an educational tool to supplement classroom mathematics instruction. It is not:

        • A substitute for comprehensive mathematics curriculum

        • A guarantee of improved test scores or academic performance

        • Professional tutoring or individualized instruction

        • A complete mathematics learning program

      • "As Is" and "As Available"

      • THE PLATFORM IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

        • Accuracy or completeness of content or NFL data

        • Uninterrupted or error-free operation

        • Compatibility with all systems and assistive technologies

        • Availability of third-party data (SportsDataIO API)

        • Fitness for a particular purpose or accessibility compliance

        • Non-infringement of third-party rights

      • Third-Party Data Provider Disclaimer

      • We rely on SportsDataIO for NFL statistics and are not responsible for:

        • Accuracy or completeness of NFL data provided by SportsDataIO

        • Availability or interruption of SportsDataIO's API service

        • Changes to SportsDataIO's terms, pricing, or data access

        • Any claims arising from use of NFL data

      • Limitation of Liability

      • TO THE MAXIMUM EXTENT PERMITTED BY LAW, DFUSION INC./STEMPLAY LABS SHALL NOT BE LIABLE FOR ANY:

        • Indirect, incidental, special, or consequential damages

        • Loss of profits, data, or educational opportunities

        • Personal injury resulting from use of the Platform

        • Errors or omissions in content or NFL data

        • Unauthorized access to your account or data

        • Technical malfunctions or interruptions in service

        • Third-party data provider failures (SportsDataIO API outages or data errors)

      • Maximum Liability Cap

      • Our total liability for all claims related to FSML shall not exceed the amount paid by you (if any) to access the Platform in the 12 months preceding the claim, or $100, whichever is less.

      • Educational Outcomes

      • We do not guarantee specific educational outcomes, test score improvements, or mathematics achievement gains. Learning results vary by student.

      • Third-Party Actions

      • We are not liable for actions of:

        • Other users (students, techers, parents)

        • Third-party websites linked from FSML

        • NFL or use of NFL data

        • SportsDataIO or other data providers

        • Schools or school districts using FSML

    • 10. Modification to Service and Terms

      • Changes to Terms of Service

      • We reserve the right to modify these Terms at any time. When we make changes:

        • Notice - We will post the updated Terms on the Platform with a new "Last Updated" date

        • Material Changes - For significant changes, we will provide additional notice (email to registered users or prominent Platform notice)

        • Continued Use - Your continued use of FSML after changes constitutes acceptance of the updated Terms

        • Disagreement - If you do not agree to changes, you must stop using the Platform

      • Changes to the Platform

      • We may, at any time:

        • Add new features or functionality

        • Remove or modify existing features

        • Change scoring systems or game mechanics

        • Update educational content and lesson plans

        • Change data providers or data sources

        • Discontinue the service entirely (with reasonable notice)

      • NFL Season and Data Availability

        • During FNL Season (September - January) - Current season data from live games

        • Off-Season (February - August) - Historical data from previous seasons

        • Game play continues year-round using appropriate data

        • Data availability subject to SportsDataIO API service

      • Changes Due to Third-Party Providers

      • If SportsDataIO changes its terms, discontnues service, or if we change data providers:

        • We will make reasonable efforts to maintain service continuity

        • NFL data and player statistics may be temporarily unavailable

        • Historical data may be affected

        • We are not liable for disruptions caused by third-party provider changes

    • 11. Termination

      • Your Right to Terminate

      • You may stop using FSML at any time by:

      • Our Right to Terminate

      • We may suspend or terminate your access if you:

        • Violate these Terms

        • Engage in prohibited conduct (including unauthorized use of NFL data)

        • Provide false information during registration

        • Compromise security or integrity of the Platform

        • Engage in illegal activities

        • Attempt to extract or scrape NFL data

      • Effect of Termination

      • Upon termination:

        • Your access to the Platform will end immediately

        • Your account and data may be deleted

        • You must cease all use of FSML content and materials

        • Any extracted NFL data must be deleted

        • Sections of these Terms that should survive (privacy, intellectual property, limitations of liability) remain in effect

      • Data Upon Termination

        • Student Data - Schools may request student data export before account deletion

        • Educational Materials - Teachers may retain printed lesson plans previously downloaded

        • NFL Data - Any NFL data accessed through FSML may not be retained after termination

        • Personal Data - See Privacy Policy for data retention after account deletion

    • 12. Governing Law and Dispute Resolution

      • Governing Law

      • These Terms are governed by the laws of the State of [Your State] and the United States, without regard to conflict of law provisions.

      • Jurisdiction and Venue

      • Any legal action related to these Terms must be brought in the state or federal courts located in [Your County/City, State], and you consent to the exclusive jurisdiction of these courts.

      • Informal Resolution

        • Before filing any legal claim, you agree to first contact us at fantasysportsmathleague@dfusioninc.com to attemp informal resolution. We will work in good faith to resolve disputes amicably.

      • Time Limit for Claims

      • Any claim related to FSML must be filed within one (1) year of the date the claim arose, or the claim is permanently barred.

      • Class Action Waiver

      • To the extent permitted by law, all disputes must be brought on an individual basis. You waive any right to bring claims as part of a class action, consolidated action, or representative action.

      • Exceptions

      • Nothing in these Terms limits:

        • Your right to file complaints with government agencies ( FTC, state attorney general, etc.)

        • Our right to seek injunctive relief for intellectual property violations

        • Either party's right to seek resolution in small claims court

    • 13. Accessibility

      • Accessibility Commitment

      • We are committed to making FSML accessible to students with disabilities. However, we acknowledge that:

        • FSML has not yet undergone formal WCAG 2.1 Level AA accessibility audit

        • Section 508 compiance has not been verified

        • Compatibility with all assistive technologies is not guaranteed

      • Accessibility Accommodations

      • If you encounter accessibility barriers:

      • No Guarantee of Accessibility

      • While we strive for accessibility, we do not warrant that FSML will meet all accessibility needs or be compatible with all assistive technologies.

    • 14. International Use

      • FSML is based in the United States and designed primarily for U.S. schools and students. If you access FSML from outside the United States:

        • You are responsible for compliance with local laws

        • Data may be transferred to and stored in the United States

        • FSML may not comply with non-U.S. accessibility or privacy regulations

        • We make no representation that FSML is appropriate for use outside the U.S.

        • NFL data is provided for educational use in accordance with U.S. licensing agreements

    • 15. Miscellaneous Provisions

      • Entire Agreement

      • These Terms, together with our Privacy Policy, constitute the entire agreement between you and dfusion Inc./STEMPlay Labs regarding FSML and supersede any prior agreements.

      • Severability

      • If any provision of these Terms is found to be invalid or unenforceable, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full effect.

      • Waiver

      • Our failure to enforce any provision of these Terms does not constitute a waiver of that provision or our right to enforce it in the future.

      • Assignment

      • You may not assign or transfer these Terms or your account without our written consent. We may assign these Terms to any successor or affiliate without your consent.

      • Force Majeure

      • We are not liable for any failure or delay in performance due to circumstances beyond our reasonable control, including natural disasters, acts of war, government actions, labor disputes, internet/telecommunications failures, or third-party data provider outages.

      • Survival

      • Provisions that by their nature should survive termination (including intellectual property, limitations of liability, indemnification, and dispute resolution) will survive termination of these Terms.

      • Headings

      • Section headings are for convenience only and do not affect interpretation of these Terms.

      • By creating an account and using Fantasy Sports Math League, you acknowledge that:

        • You have read and understood these Terms of Service

        • You agree to be bound by these Terms

        • You are authorized to creat an account (age 13+, or under 13 with parental consent through school)

        • You will comply with all acceptable use policies

        • You understand FSML is for educational purposes only and involves no gambling

        • You will not extract, scrape, or misuse NFL data provided through SportsDataIO

        • You will use NFL data only within FSML for educational purposes

        • You have read the Privacy Policy

        • You understand the technical requirements and limitations

        • You understand that NFL data availability depends on third-party providers

      • For Students Under 18: By using FSML, you confirm that your parent/guardian or school has consented to your participation.

      • For Teachers: By registering a class, you confirm you are authorized by your school to register students and manage their participation, and you will ensure students use NFL data appropriately.

      • For Parents: By allowing your child to participate, you confirm you understand these Terms and consent to their use of FSML.
